Anyways, on-topic, I think its pretty funny people are getting charged for this, it's kinda odd to be charging a 14 year old with child pornography if its herself, but I guess she'd be liable to distributing pornography to minors.

Plenty have done it before her, and plenty will continue to do so. It's pretty stupid I agree, but it's going to happen and I don't really see what all the fuss is about, besides the fact she's being treated extremely harshly. :roll: :|

 

 

 

I actually feel somewhat sorry for her, I remember at that age all I wanted to do was have fun (still do).

 

And lots of my friends were first talking about sex, and actually starting to try it. There's nothing really wrong* with it as such, there's just alot of stigma attatched to acting outside of "government guidlines" ie, the law.

 

 

 

*Depending on your morals, and values. Some people will completely disagree with me, however I'm merely voicing my opinion.

She's not a sexual offender in any way - legal or otherwise, because the law is simply faulty here. Those laws were set to protect children from exploitation by adults. And furthermore, there's nothing less than a sexual offender that is severe enough to compel anyone to stop their acts. If anything, a new law should be set as a median between no action and sexual offenses. But what really needs to be done is parental counseling and involvement. If I was 14, I'd be far more concerned about getting my phone taken away then status of "sexual offender." Something needs to be done, that's for sure, but it should not be to label a 14 year old girl a sex offender for the rest of her life when she can barely contemplate right from wrong.

See this is exactly what I thought you'd do. post a link wait until you know how people will sway on the subject, then post vague information on why you think they are right. The problem with this situation is it isn't black and white. Is she stupid for doing this? YES! Is she guilty of taking naked pictures of an underage child? Yes.

 

 

 

The situation arrives on the base principle of child porn, that no matter what the idea that child porn is around is proof someone is a victim. You don't get a picture of an 8 year old girl and not think, someone abused her, because the photo exists is proof. The idea that a girl would willingly take a picture of herself challenges this theory. That she wasn't coerced nobody had any stake and this was a gift. There is literally no victim in the dissemination of this photo to someone she is in a relationship with. Myspace for people her age is considered private communication like a cell phone.

 

 

 

I think they DA is trying this because if she isn't charged with it, then anybody found with these photos aren't held accountable. Most likely they have evidence that there are people in custody of these photos and make sure they are convicted they have to proove that the photos themselves are illegal.

While by the letter of the law your 100% correct, the reason there are laws against distributing child pornography is to protect children. This case is puzzling as the person involved here would normally be considered the victim if the material was distributed by somebody else, so it poses the question of whether you can be both the perpetrator and the victim of the same crime?

 

 

 

My own personal view over this is, because it is her that is depicted in these pictures that she is distributing then she shouldn't be charged. There is a difference between paedophiles distributing images of abuse and what is basically a very stupid girl who is trying to impress somebody (albeit in a very misguided way).

I already knew that it is illegal for ANYONE to have and share child pornography (There was a case of two 16 years olds sharing pictures being prosecuted for having CP, I could understand that). I do feel that this is very different. Just because a girl took a picture of herself and uploaded it, she shouldn't be labled as a sex offender. It is as bad as looking at yourself in the mirror or going streaking while being under 18.

Something needs to be done, that's for sure, but it should not be to label a 14 year old girl a sex offender for the rest of her life when she can barely contemplate right from wrong.

 

 

 

She's 14, not 2. Granted she's a dumb 14 year old, but that's plently old enough to know right from wrong.

Even if what she did was against the law they should label her as a sex offender, She'll have a hard time getting into college and finding a job when she's older having that kind of label on her police records. At most they need to fine her.

 

 

 

Isn't it in the MySpace code of conduct to not post any kind of pornography?

I don't think that she should be labeled or convicted as a sex-offender. There are some other charges to satisfy the punishment, but registering her as a sex offender virtually guarantees a crappy life for her.

Plus, was there actually any sex involved? Exactly. But even if that case is made with people that possess other child porn, it's all about context.

Man, if this goes through, she's going to have to introduce herself to neighbors and tell them she was convicted of child pornography. You know how [bleep]ed up that will make ... Everything for her? I doubt people will let her live in most neighborhoods, trying to kick her out before she can even explain.

Think of the actual child predators who know where this hurt little girl is located. Somehow her name is not allowed to be listed in the media but if you go to "state registry.com" you can find a picture, her charges, where she lives, her age.

Heh, 11 year old murderers, 13 year old fathers and now 14 year old 'sex offenders'... doubt she'll be a registered sex offender though when this is all done.

 

I can remember at least 5 cases where a female has been convinced of child pornography for sending illicet photos of herself to peers. And from memory, some of the male recipients were charged for possession of child pornography and most of them were then required to be registered as sex offenders.

 

 

 

 

 

I will not be surprised if this girl, and anyone who has the photos (even in their browser cache) is gone after for being in possession (or distributing - is the case of the girl) child porn.
