Why not? He's not outspokenly conservative enough and so they would have no credible reason to without trashing their own reputations. He reflects the kind of justice O'Connor was because we're not quite sure how conservative he will be on the bench, and when it comes to the judicial branch that usually means they will lean moderate/left.
