yes like my avie is. is there a problem with that? i took them from the wallpapers and croped them bordered some of them and made them avie size

Yeah, if you're giving it away it's supposed to be at least 50% your own work. I don't think cropping and bordering them constitutes 50%.

Not only are these not exactly your work they're also unusable as Avatars on these forums due to them being over the 8kb file size limit.
