Thanks for bringing this to our attention, I have added a note to the quest guide about needing to be on the normal spellbook for the quest and I have also updated the dungeon image in the guide as well. Well he was still actually serving his time, he was out on a 3 day pass. There has been a few people to make that mistake I think. He was still being punished for his crime when someone else came along and punished him again.
