hey peeps.

 

as a few of you probably (don't) know I recently started up a design company based on myspace. I'm in the process of a web design job for a band (being paid for it too!) and I need to know about website and image copyright. all the stock images used are taken from sxc.hu and royalty free, but there are photos of the band and content and suchlike.

 

What do I need to do to claim copyright on this?

 

Is it enough to just write "Copyright (design company name) 2006, all rights reserved" ?

 

or what else should i do?

As far as I know you don't have to 'claim' copyright on anything. As soon as you create the design you hold the copyright.

Yep, this is true. As soon as you put it "out there" it's copyrighted.

 

(as long as you don't say "I give everybody permission to take everything" :P)

Really as long as you don't claim something that really isn't yours and don't not claim something that you made. (So really just don't say "Hey this is my website, feel free to steal it.")

You might want to check the myspace TOS, but otherwise, anything you create is automatically covered by copyright.

Indeedio, it's just a law, so you can't violate that. But make sure you do add a couple of those copyright signs just to make sure you show people you know what you're doing.

 

And there's also just a thin line between copyright violation and ripping tunes, just remember some of the Madonna songs that apparently ripped some guy's tune. It's not easy to prove someone's stolen one of your designs or tunes, because they can just claim they've had the same luminous idea.

Photo copyrights are a minefield (frequently exploding on newsgroup - rec.photo.digital ).

 

 

 

Unless the photos are a "work for hire" with copyright assigned to the commissioner, copyright rests with the photographer and the usage rights are dependent on whatever contract the images are supplied under.

Yeah, i talked with my tutor today (our last half terms work was on music copyright, finished today) and he said as a rule once you create the work and slap a C and notice on it there's not much they can do!

 

i think i'll put some sort of notice on the photos too though, otherwise magazines etc might use them (about to be signed band...)
