If a British man allegedly broke the law in Britain, against a British company and had been told there was not enough evidence to prosecute him, would it then be right for him to be shipped to a different country so that that country could try the man, under their laws?

 

 

 

I presume that majority of you would agree with me and think no. Now let's alter the scenario: If three British men working for a British company, told by the Serious Fraud Office (SFO) there was insufficient grounds for launching a case, were sent to America to face trial under American Law, why then would this be any different?

 

 

 

I'm referring to the recent case of the Enron Three - or NatWest Three - that are being extradited to the U.S, without them having broken an American Law. They allegedly inflated its profits and filed false accounts to hide debts. The Enron crash affected lots of economies, particularly the American economy. Regardless if these men are innocent or guilty, either way they should be dealt with in Britain. Under British Law.

 

 

 

So why then are they being taken to America? Because of the 2003 Extradition Act. Which states that if the evidence is sufficient to merit extradition then the person will be extradited. However, this does not apply when requested from the USA, Canada, Australia or New Zealand. Meaning if any of these governments wish to do so, they may extradite someone without evidence.

 

 

 

Let's look at a different example: Two men wanted by the American government because of alleged - yes, not proven - involvement in terrorism. Obviously the men want not to be extradited, as America is hardly renowned for their human rights record. The defendants fear they may be labelled enemy combatants and locked in Guantanamo Bay.

 

 

 

So why does America get away with this unlawful extraditionary process? It is a breach of British citizens rights and a perfect example of how the British government needs a major re-think of its policy and the law it makes. One can only hope that the Opposition's attempt within the House of Lords to ammend the law is successful, for the benefit of the British citizens.

True thats a major screw up in the law and there should be done something about it..

 

All crimes should be dealt with in the country it has been comitted period.
