Iv gotten this message before when I talked about suicide in one of those funny ban appeals, as I heard they sometimes got people instantly unbanned.

Hah. I suppose they can count it as some sort of 'appreciate the customer' gesture. Or it's an automatic response to any report involving the world 'suicide' so they can avoid any legal blame.

Here we go again. Jagex customer support is GREAT. I have NEVER had an in game problem that was not either

 

#A: A bug, easily reported by their report bug system

 

#B: An in game question, specifically tailored to my account, that I received an answer within 10 minutes on the forums that was FAR more helpful then any generic report could EVER be

 

#C: An unfair ban or mute, which was appealed and lifted in a matter of minutes

 

 

 

Jagex doesn't care about players, though. They are a COMPANY. They are interested in MAKING MONEY. As EVERY other company is. Why is this constantly parroted? Thankfully, good customer support is in line with making a profit, so we get a very nice system.

Jagex probably couldn't care less if you were serious about killing yourself, they have plenty of other witless kiddies who are perfectly happy and still paying their 5 smackaroos a month, the automated message says that much. And as someone else said the reason they send a message at all is probably for legal reasons. They're superficial interest in your "real world" safety is pretty laughable though, and deserves a LOL.

studying law i'd just like to run through the tort of negligence (duty of care): (english law, doesnt apply in other countries) btw its quite long and most likely boring so if you dont want to read it then dont :lol:

 

[hide=]A. duty of care (under donoghue v stevenson (1932))

 

i. forseeability; is it forseeable that if someone says they will commit suicide that they would? yes

 

ii. Proximity; either through time/space/relationship. jagex are not close to most customers in time or space, but in relationship they are close in the fact that you are a customer of theirs so they owe you a duty of care.

 

iii. Just, fair and reasonable; is it right to enforce a duty of care upon jagex to care for its customers? yes

 

 

 

B. breach of duty

 

i. forseeability of harm; was it likely that the harm that occured, would occur? this would be debated as it is not necessarily likely that someone would kill themselves over a game.

 

ii. Magnitude of likely harm; if someone says they will kill themselves and then proceed to do that, the harm is obvious.

 

iii. Cost and practicality of preventing the risk; it would be too costly for jagex, to close down runescape, as they would lose profits that they as a company should receive, such as is shown in Latimer V AEC ltd, where the factory got flooded so AEC ltd covered the floor with sand or sawdust. Latimer being a fool managed to fall over in the only spot where the floor hasnt been covered, hence the lawsuit. However it was decided that AEC ltd, had taken reasonable steps to prevent or minimize the risk, so they were not liable, as it would have been too costly for them to close down the factory for a day. So jagex have attempted to prevent the risk and are therefore not liable (thats why they do it =D> =D> to jagex's legal team)

 

iiii. social utility; does not apply.

 

 

 

And finally C. Damage

 

i. Causation in fact: 'but for' test. But for jagex not attempting to help the player, would he have killed him/herself? basically if jagex did not attempt to help the player and the player killed themselves even though they knew it was a risk, they would be liable. .

 

ii. Causation in law: was the damage too remote? no it was not as the type of harm that was supposedly going to happen did actually happen.

 

iii. Thin Skull rule: even if the victim had a special infirmity or increased risk to something you are still liable for them. 'Take your victims as you find them'

 

iiii. (bit of latin now :wall: ) Novus Actus Interveniens; the new intervening act, which could break the chain of causation, but does not apply here.

 

 

 

So basically by trying to help the player they remove liability.[/hide]
