Haven't seen the movie in question, but you're not looking at reality from an objective viewpoint. Everyone wants to benefit from any given situation with any means necessary. Putting highly skilled hackers to do nothing but socialize with organised criminals for years in a federal prison will eventually expose them to extortion or coercion, the information and know-how will be passed on to people outside of prison who will hack for purely financial purposes and cause further harm. It's also not uncommon for companies to hire hackers or ex.convicted hackers for security testing [1] due to their often superior technical knowledge. The FBI has nothing to gain and everything to lose in the form of further financial and strategical losses by dealing excessive prison terms against highly skilled hackers. They are actually pretty often offered a highly paid job either at an antivirus/firewall laboratory or company, or a government agency. Few companies hire burglars so they can observe their techniques to make a compound safer... Because even the lowliest common thugs can succesfully steal a TV set. The amount of people who can bypass NASA-level security can be counted in the dozens at most in the entire country & are very hard to find. Their skill can come pretty handy when the FBI has legal authority to make that hacker either work for them, or sit in a cell if he's convicted.

The kid was doing it so he could attend further education and improve his life, not so he could financially gain from it. A strict fine yes, a lot of community care yes, helping his school build a much better anti-hacking system yes, but jail time? If I was the judge I'd sentence him to resit his exams in a properly controlled room, a lot of community care and help his school build a better security main frame. We don't know the full story, it seems like the guy had no chance at Uni if he cheated on state exams then had to change his exams result via hacking. Props to the guy that he wanted to attend Uni so much he hacked his school, at least he didn't give up on his goal.

On average you get 5 years for aggravated assault, 8 for voluntary manslaughter, 12 for murder... 38 for altering school grades/stealing test results? Even most war criminals sentenced to prison by the ICC get around 10-20 years on average for extermination, mass murder and genocide of civilian populations... Your saying he should have demanded the teacher change his grades at gunpoint, because it would have netted him 1/4th the jail time, and probably have a less chance of being caught? I 'hack' when I cobble together a basic script to automate fan control of my graphics card. Hacking isn't a bad thing. Changing your grades through hacking is a bad thing, deserving of a steep fine and community service. Not 70% of the rest of your life spent in jail.
