Most people wouldn't, probably. I would still find it a problem and would want it fixed. It would be a double standard otherwise.

I'd still think the 10 year old was a [bleep]ing idiot for giving out personal information, but by 13 there is absolutely no reason why they shouldn't know how giving personal information is a bad idea.

 

Also, how is a 17 year old any less capable of making a decision like this than any 18 year old? Age isn't some magical thing that gives you all of the answers as soon as the Earth goes around the Sun 18 times.

So correct me if I'm wrong, but are you saying that, at 18, your brain magically snaps into cognitive mode and finally you are now responsible for your actions? It's just a legal guideline - it doesn't mean all adults are inherently superior decision-makers than all children - I can think of plenty of exceptions.

Has she hit puberty? Probably not. I'm at least arguing from a pubescent standpoint. If she hit puberty by that age, she should be cognitively tested, but chances are sure won't have that great of maturity because he/she'll have just started puberty.

 

At that age, you are usually still a child. Pre-pubescent. Which is a child.

 

Simply put. If she was 10, probably NO.

But hey, I guess by your logic if I find a girl with a mental disability I can manipulate her into thinking she wants sex from me and then have sex with her all I want. It's extreme, and the girl isn't mentally disabled, but that is what you are basically saying. She is no where near fully developed mentally, and she in all likelihood isn't finished puberty or possibly even started.

Or at least when they hit a point where they can reason. I've known a lot of people who were able to reason around that time, and some who weren't. We were all taught not to give out personal information or talk to strangers since we were even younger.

Girls CAN start puberty at 10, but it typically take until 17 or 18 to finish. There is exactly 0% chance that she is through puberty. And my second part was that your post seemed to be arguing only about the physical development, which isn't very good.

1 & 2: You came late to the party, but the first few pages were people saying that the girl "wanted it" and "well she wanted it so its not really rape" and was responsible for what happened. This is what pissed me off, not them calling her stupid. Kids that age are supposed to be stupid.

The funny part is that it it's only "rape" by law. When I hear of "rape" the picture that's painted is some random girl minding her own business and then all of a sudden getting surrounded by three guys and undressed while putting up a big fight. Not some preteen wanting attention and telling an old man to come to her house and then him proceeding to have sex with her - all without the screaming and scratching. Don't get me wrong, they are both despicable acts, but there is a pretty substantial difference. To equate the crimes is an insult to the women who actually were physically forced into a terrible situation against their will.
