Nazgul740 Posted October 19, 2006 Share Posted October 19, 2006 Ugg so anyway i was in a car crash... Basically it was foggy and i had pulled up to an intersection... I checked left then right then pulled out... I didn't see a small silver car that zipped over a hill to my left and decided that today was the day to run into the freaking big butt van that was slowly pulling out... Mmk so yeah i got a ticket for failing to stop at a legal stopsign... :? Oh yeah, she was going so fast that she hit me and went up an embankment that was at least 8 feet high... not only that, but the intersection was sopposed to be only 35 mph from the direction she was coming from... So anyway i get the ticket and it turns out my van is totaled... big freaking woop there... I most likely won't get the ticket on my perm record as if i go to court and show that the damge to "her" car is repaired then ill get off the hook.... But i mean cmon... i get no van and the lady who if she was going the speed limit that the sign said to go wouldn't have hit me gets off scot free except that my insurence will have to pay for her car... #-o I admit, this accident was probably my fault, but if she had been paying attention to the road then it could have been avoided... I had to drive with my driving instructor yesterday and we were coming over a hill (going 50 in a 45.. He told me to speed lol) and at the bottom there's a car pulled off to the side. I didn't think much of it until we were getting near it and all of a sudden it pulls a U turn right in front of us.. Thank god for my reaction time or I probably would have killed the lady (I would have hit the drivers side door).. I too was wondering the same thing. There was a terrible wreck in my area earlier in the week. The woman who was driving was decapitated. She had her three-year old daughter in the car as well. The child was alright. Before that, there was a wreck just down the street from me in which an old man was killed. I'll be getting my liscence soon as well, and I swear that if I ever have a wreck, I'll likely pass out from shock and never wake up. I get so nervous while driving. Anyway, to the original poster: I'm glad you and the woman are both alright. Though, it's an odd situation. I don't know whose fault it would be. This was a while ago and we were in a suzuki sidekick (small SUV), my brother being a golie (like me) has excelent reaction and pulled into the other lane (thaks god there was no one there) and practicly rolled the truck over. The poor suzuki was prety much on 2 wheels. A larger truck would have rolled over :ohnoes: . Adults have experiance, teens have reaction speed to compenstae for lack of experiance. There was also the guy who cut of a city bus on a bridge. The bus won -.- . He lost a bumper and the bus lost paint off its bumber (like one scratch). Don't cut off buses. The Highway patroll officer said she was going about 50-55mph... he didn't know there was a 35 mph sign at the start of the hill/curve leading to where the wreck happend... I didn't see the sign till i rode through the place again coming from another direction... Probably is my fault, if i had pulled out any faster though i would be in the hospital would have gotten me in the drivers door... VOV Posted October 20, 2006 Share Posted October 20, 2006 Based on your story I see no possible way you could lose in court. It sounds like you stopped at the intersection first. If that's the case you had the right-of-way. Even if you both came up to the intersection at the same time, you were to her right and she should have let you go first. You make it sound like she didn't bother to even bother to stop. That alone should be enough to make the accident her fault. If she was going 55 in a 35 it's definately her fault. Oh, I see well it was a square sign under the normal intersection sign and it was the same color as the sign...
