Just a reminder, for people who think Jagex is on shaky legal grounds, remember that Jagex has their own lawyers looking over these things. In far greater detail then us, if for no other reason then they have access to more detailed information then us.

 

Indeed, but the point being that they've got almost nothing to gain from this except to stop botting. I'm just thinking of the monetary implications of this, because I'm not 100% sure how much money they'd have to throw at the courts to even "win" this kind of thing.

Actually, technically, they could sue for swearing, but there would be exactly zero they could gain other than losing a ton of money and PR. I'd almost expect this case to be thrown out, but I'll just observe for now, because companies like this come across as annoying.

Everyone, keep in mind that a Terms of Service is not entirely a legally binding contract. If the Iphone jailbreak case is any indication, the judge actually didn't even consider those terms and threw them out, simply because they're so badly slanted against the consumer and difficult to read and understand for the average person.

 

Please use another example, if you wish to argue that. Jailbreaking an iPhone is very different to using a Botting program, effecting the other hundrds-of-thousands of users operating that product whenever you're online.

I've consulted various websites, and can't find any that state that the Terms & Conditions aren't legally binding. If, when brought to court the T&C are vague or too ambigious, there's a high chance you won't win.

 

You must not reverse-engineer, decompile or modify any Jagex Product client software in any way (except to the extent allowed by applicable law). You must not use a modified/customised version of the client software or attempt to sub-license it. You must not create or provide any other means by which any Jagex Product may be played by others (including, without limitation, replacement or modified client/server software, server emulators).

 

You must not use other software to gain an unfair advantage in our games. This includes automation tools, macros, bots, or auto-typers. You may not circumvent any of our mechanisms designed to automatically log out inactive users.

There's absolutely nothing vague about that. It's also seen in-game whenever you pull up the Report Abuse screen.

Precisely. Just like all the so-called experts in some of the other threads there's no-one here who really knows what the detail is or what the avenues are. Its the usual blase statements that the tipit forums have become accustomed to. All we can do is wait and see what happens next.

I'd never argue that just because someone has corporate lawyers/ lawyers they know what they are doing. There are NUMEROUS reasons Jagex could do this besides actually thinking they can get money out of botters by winning a law suit.

 

My argument has never been that I either know more then Jagex, or that Jagex won't sue, etc. It has, rather, been that Jagex won't be successful suing INDIVIDUAL bot users, and actually getting money out of them.

 

The point of discussion is to have discourse, which includes debate and argument. Throwing around the drivel you've been doing is neither on topic, nor contributory, and would, if anything, be deemed trolling.

 

In fact, I'd say that if we ALWAYS assume Jagex/their lawyers know what they are doing, and thus their is no point talking/discussing it (your basic premise) then we should just lock any thread such as this.

 

1.) Scare Tactic

 

2.) PR/Notoriety

 

3.) An attempt to get the news out to players who stopped that "bots are gone" (Seriously, people outside of RS are talking/blogging about this on some scale)

 

4.) Try to scar e people into settling out of court (much like the RIAA does)

 

ETC.

 

Looking simply at the surface level is far too shallow, ESPECIALLY the lack of (winning) precedent and the cases were other corporations (Jagex in 09, blizzard last year) actually LOST.

Alternately, they could just settle the matter outside of court, but knowing how these companies have just so much money to throw at the courts, I'm not so sure.

 

Also, I don't even play this game, as I stopped well over four years ago, so how would I know what the abuse report is?

I won't even comment on this because the company as a whole has grossly mishandled a bit too much for me to take them seriously. Their policy on stuff is to blot it out if they're put in even remotely a negative light, and such it's a very draconian form of censorship. I even have examples of this in video form from 2006. What's the big deal people have with this? I realise in the current "Occupy Everything" society, we hate business, but really, a business is gearing itself to protect and improve it's image to potential (note: new, not current) players, is somehow a huge issue?

Only because of VG&C and the private boards I'm allowed into. That's literally the only reason I even use this site.

 

And there is a topic of the GJA and some player, it's on the first page here. In short, a forum mod posted a video showing a ton of bots spamming gold-selling sites. Jagex pulls the video and removes that guy's forum mod status. And they can protect their damn image if they want, but they're doing a really shoddy job of it.
