MUST WATCH: UPDATE: Holland considers virtual theft a crime

You borrow someone's car.

You didn't pay for it, you only pay for the gas it uses, and fill up the tank when you're done with it...

But right as you go into the Gas Station to pay the bill, the car gets stolen... The Gas Station isn't going to let you leave woithout paying for the gas, afterall, its not their fault the thieves forced you into giving up your car keys (and hence, the car)

Who is the owner of the car? Not you. It was from the person you borrowed it from. Do the thieves now not deserve punishment because now THEY drive the car?

Translate the car with the extra gas to the time and effort you put in to get said Amulet and Mask, the original owner to Jagex, and the account it was stolen from to yourself...

TADAA!

Absolute nonsense. In your example, the thieves deserve punishment because they are now in possession of the car that they obtained illegally.

Just to refresh your memory

Theft

Theft\, n. [OE. thefte, AS. [thorn]i['e]f[eth]e, [thorn][=y]f[eth]e, [thorn]e['o]f[eth]e. See Thief.]

1. (Law) The act of stealing; specifically, the felonious taking and removing of personal property, with an intent to deprive the rightful owner of the same; larceny.

Note: To constitute theft there must be a taking without the owner's consent, and it must be unlawful or felonious; every part of the property stolen must be removed, however slightly, from its former position; and it must be, at least momentarily, in the complete possession of the thief.

-------------------

N.B.

a) depriving the owner of the property

B) being in complete possession of property

As we know, in RS, Jagex owns all the property, the owner was not deprived of it, the young lad never owned it, the "thief" was never in complete possession of it (even momentarily).

As noted in earlier posts, the assault was enough to convict; this could not, however, be theft.

Happy to discuss

A so I can just come to your home and steal your passport/idcard?? - You're not the owner of your ID card/Passport: the goverment/EU is!

First they came to fishing

and I didn't speak out because I wasn't fishing

Then they came to the yews

and I didn't speak out because I didn't cut yews

Then they came for the ores

and I didn't speak out because I didn't collect ores

Then they came for me

and there was no one left to speak out for me.

Like I said in my previous post - your time does not equate to anything of value UNLESS there is a signed contract between two parties in which one agrees to exchange currency/goods/services for the others time, at a predetermined rate. The time the boy spent getting the items does not immediately become some sort of 'gold standard', making the items "stolen" objects of VALUE in the REAL world.

The question here is: Do you think that something that is not tangible (IE. it doesn't actually exist in the sense that you can hold it in your hands and 'feel' it) should be assigned value, equal to currency or possesions?

I stand by my previous assertion that assigning intangible objects/items value is a dangerous path. (I know we basically do it with money in our financial system, but that's besides the point and a different point entirely!)

There has been a trial earlier about this guy that " stole" stuff from another online game, Habbo hotel. I'm not sure what came from that....

That's a completely different thing - in Habbo Hotel, you must pay real money to buy those items. One case in Finland included a person thieving 500 worth of items from another person. (btw, Habbo Hotel ain't a game, it's a "virtual chat", or a "8-12 year old children's playground", like I call it )

But seriously, threatening someone with a knife to get some pixels they can get quite easily themselves?

...

No-life nerds have moved from idiocy to violence. :?

Should this be punished, I won't take a part in that debate.

Yes, but you forgot the other thing you exchange real life money for: Services. The action of moving around Jagex's property is a service which the customer pays for. RWTing is not a buy/sell trade, even though it appears to be, it is a service.

You misread the rule.

Game items must only be exchanged for other items/services within the game. Exchanging game items for items or other benefits in other online games, real-life money or other real-life benefits is not allowed.

A can only be traded for A or B.

That does not mean B can only be traded for A or B.

Whoops, yes I did. I think I was very tired that day.

Camera guy: still laughing

Matt: You want the funny shit that happens here and there, you think it comes out of your [bleep]ing [wagon] pushes garbage can down, don't you? You think it's funny? It comes out of here! running towards Camera guy

Camera guy: runs away still laughing

Matt: You think the funny comes out of your mother[bleep]ing creativity? Comes out of Satan, mother[bleep]er! nn--ngh! pushes Camera guy down

Camera guy: Hoooholy [bleep]!

Matt: FUNNY ISN'T REAL! FUNNY ISN'T REAL!

I don't believe stealing virtual items should be consider theft. the brats should have been punished for the beating but nothing more. And excuse me, but the author of the article tried to make this case by stating that stealing electricity is a crime and electricity is not tangible. Electricity most certainly is tangible. And if you don't believe that, go stick your finger in a light socket. :o

Who is the owner of the car? Not you. It was from the person you borrowed it from. Do the thieves now not deserve punishment because now THEY drive the car?

The original owner of the car still owns the car. that has nothing to do with the thieves or the gas. The thieves are responsible for the theft of the car. The person who pumped the gas is responsible for the gas bill. It's not the stations problem where the gas went. If you pump it you pay. end

Anyway, this analogy doesn't work as your talking about tangible goods.

The person who borrowed the car could still be held responsible for the theft, but this is a bad example. I can give you a better one.

Bob loans Mary the use of his textbook, with Mary promising to keep it in the same condition.

Mary, either through accident or intention, damages or destroys the book.

Ultimately, Bob must replace the book, but may take Mary to court to cover the cost of the book. [Please don't think of it as silly - some of my college texts run over $120, and I'd want money if someone destroyed my book!]

Oh, by the by, gas is tangible, too. Just like electricity, in your case. Except you get a lot less violent jolt through every cell of your body, and more gas fumes. -.-

...Alright, the Elf City update lured me back to RS over a year ago.

WOW,this is amazing.I never thought something like this would happen.I feel sorry for the kid beaten up for his possesions, that was wrong :shame: .But at least the kids who did it got charged.I hope this happens in more countries like mine,I do think it should be an offence to do this, especially for members since they bloody pay to play.

Expose yourself to your deepest fear; after that, fear has no power, and the fear of freedom shrinks and vanishes. You are free.-Jim Morrison

And excuse me, but the author of the article tried to make this case by stating that stealing electricity is a crime and electricity is not tangible.

Wasn't that the judge who said that?

I suppose "tangibility" shouldn't be held as the defining factor of what constitutes theft. What it should be is "something with real and monetary value in the real world." Due to Jagex's banning on trading for real-world items/cash, GP has no monetary value except for the black market value, which obviously cannot be applied since it is illegal. No value, no theft. No theft, no theft charges.

But I suppose if it gets the kids more community service as punishment, it won't be all bad. That'll teach the little brats to take a game too seriously...

don't worry, you are going to "hell" anyway. wanna race to see who gets there first?
