Now Jagex is an English Company which is where I live and I recently messaged their customer support people on a matter of whether I had any black marks on my account (which i did not think i did have but i had heard people where worrying about it). And also had there been any reports filed against me. I just requested whether there had been any and not the name or ip of the person who did that though :) Now i got a reply back to me which said that they were not allowed to give details about my account such as had anyone filed reports against me. They were able to say that there were no black marks though. Now this is the bit where i want other people to either tell me if i am wrong or bring their own veiws in on this. I have worked in insurance before so i had to know certain things about the data protection act. Now one of the rules in the UK at the minute is that if someone requests any digital data that you have about them at all, it has to be provided to them. This means if i walk into JJB sports and i see that a CCTV camera has seen me walk in, i can request a copy of that film as it contains digital data about myself. So, am i legally abliged to know if there are reports filed against my account? This may seem trivial but i like to know this kind of thing :) - My skills are now really, really lame ! Time to fix that! -

The reason Jagex did not tell you was probably because they didn't want to spend the time looking for that information. They use the Data Protection Act in many of their responses yet I doubt that they are very familiar with it. Anyway I'm sure the type of information they hold about your character is a grey area, since they do own all the characters and everything that is in the game. You don't own anything so therfore don't have a right to know what is being held against your in game character. Oh I am almost certain that Jagex has a member of staff or a team who knows what the data protection act is all about. Almost all companies (well big ones) have legal teams who make sure the company does not get into any(or can get out of) legal problems.

You clicked to say that you understand that the character legally remains the property of Jagex, and as such it does not legally represent you in any way, except for the information you gave when creating the character. The only information they are legally obliged to divulge is that which you gave them when you filled out the form for the creation of the character, (and possibly the IP it was created on if they store that). Therefore no, as the character does not legally represent you, nor is it legally your property, you have no legal right to see the number of reports filed against you. They tend to get scared and refer you to the corperate site. :P At least, that's the experience i had when my best mate was perma banned. Unfortunately he was so wound up by it he just completely quit the game, never bothered to take it further. I'm not in the mood atm, but if i get bored later i'll look thru a couple of books and get you a comprehensive answer about where you stand. p.s. January 2, 200620 yr It would not surprise me if Andrew Gower didn't know too much about DPA himself, but that he just seeks legal advice when and if neccessary. I beleive Phil is right about the fact that you have to pay to see the information held, i learnt this training for my job (Mobile Phone Insurance) and we have to take FSA tests (Financial Services Authority) which governs and underwrites our insurance, and we have to know a fair bit about insurance concepts etc. All i know is that we are not aloud to delete any memo's placed on our customer database, and not to include opnions because they are aloud to request it, and its big trouble if we write something that isn't fact or relevant because it can be considered slander. In relation to this query i would say that he probably isn't obliged to tell you if you have had any reports filed because you are not your character. Jagex provide you with login information but you don't own anything, the accounts belong to jagex, end of story really. The fact that you might pay for membership is also irrelevant, before someone brings that up. :P

Sorry, but thats how it is :lol: Correct. Your character is not you. Privacy protection laws extend only to the individual, not to fictional characters created by that individual.

I mean, I'm sure they say something in there..

January 3, 200620 yr Interesting question :) Unless they have a legal ground for withholding the information, they have to disclose any information they store that can be tied to you. Note that it doesn't matter if the information is regarding an account that remains Jagex property. That only says they can do whatever they want with the account, including deleting it for no reason at all. But that doesn't mean they can withhold information regarding your account. Any information about your character that they might store, such as black marks, can be tied to you. When you register contact information for your character, or pays for membership via credit card, they know who you are. I'm not too familiar with the UK Data Protection Act, but the underlying EU directives make these laws pretty similar in all of Europe. Where I live, they would have to disclose anything they store if I ask, and also inform me when they register anything about me that they get from someone other than myself. To conclude, they have to disclose how many black marks you have against your account if you ask them. They might not do this through customer support, but they must disclose it if you write them a letter like described. If they register who reported you, how many times you have been reported, a summary of what you were reported for and so on, they have to disclose this too. But if they don't keep a record of this, they obviously can't disclose it. Also, they must inform you when a new black mark is registered against your account, as long as you didn't report yourself or something.

You might control that character, but when you created your account you agreed that it was not your property. Therefore Jagex is not holding any information about you.

However, I doubt that the customer support employees would have knowledge of the data protection act and use it correctly.
