Whether or not are you are actually drinking is irrelevant, if no one claims ownership of it, the fall back is to the driver/vehicle owner (who is usually the same person). There are places which will enforce this concept (especially in relation to drugs in the vehicle) so alcohol is no different. It's not [developmentally delayed]ed, just following the process of get a person who willingly confesses, or get the owner/driver and let them sort it out with the person who is actually guilty. Either way someone takes the hit for a broken law. Who it is, is entirely up to the occupants and their willingness to take the blame for their own actions.
