  1. Sorry I'm lost here, someone used the acc recovery feature on someone elses account? Exactly. Over the past couple of days, Ive read a lot of people claiming to do this on various fansites. With all the stat tracking sites nowadays, its fairly easy to identify accounts that are inactive and attempt to harvest them.

In both of the cases I mention, the plaintiffs were successful and received monetary damages. But in the Chinese case: I dont see any indication of a similar stipulation in the Metin 2 case. Still think that Jagex can hide behind their ToS when other companies couldnt?
  3. But I wasnt claiming that fame was the justification, and I havent noticed that anyone else is. No one is claiming special privileges here. What we all seem to be saying is that Jagex had first-hand knowledge of what was taken and where it was; they just CBAed to fix it.
  4. While that section describes RWT, it also applies to any items in general. ANYTHING on your account (items, xp, time, ect..) belongs to Jagex. Just because you spend 100 hours of your personal time to buy items with other virtual items does not mean your "time" gives you rights to those items. So the point is, the Hats were, and always are, property of Jagex and not the player. You are simply renting them. If a rented car is stolen, does the insurance company reimburse you for any damages to the car? No. They would reimburse the car company. In this scenario Jagex is both the insurance company and the car company. You (as the consumer) can't sue the insurance company for not giving you money for a rented car.. You are simply out of luck with the old car, and have to work to rent a new one. In those cases, law trumps ToS. In the current situation, Jagex removed the opportunity for law to run its course by deleting the stolen items before the rule of law had a chance to take its course. Now of course, Jagex can just whip up a thousand hats if the legal process dictated it, so there is no real harm done (yet) in deleting the hats. But it’s folly to suggest that Jagex’ TOS protects them from ever having to do so.
  5. I acknowledge your points and I have no answer in those cases. However, in this case - and I quote Mod Mark H - "As soon as we became aware of the situation we acted quickly banning the hijacker's accounts as well as removing any items & wealth stolen. " - which means they had the information they needed to return the items. There would be no duping in this case. But instead of returning them, they removed them forever. If Mod Mark H had hidden behind "terms of service" then that would be different. But he didn't - he wrapped himself in the code of law. The victim in question should have recourse to recover those items from Jagex if Jagex is going to use that same law to seize them from the hijacker. Items taken as a result of hacking can't be stolen when it is convenient for Jagex and not stolen when it isn't.

Without naming the player in question, I will only mention an accumulation of 1000-ish Santa Hats. While I applaud Jagex going after the hijacker and stripping him of his ill-gotten gains, how in the name of Hades can you justify not returning the stolen e-items to their rightful owner? If your house was broken into and the police recovered your items, yet refused to return them to you, all hell would break loose. Yet somehow, Jagex justifies their policy of never returning items in these cases. How can you justify using the law as a pretense to seize those ill-gotten e-items and then not return them to the rightful accountholder? Please note that Mod Mark H cites US & UK code of law in his post. I personally, am as disgusted with Jagex as I am with the teenaged punk who pulled this off. Could a victim of e-crime not use those same codes of law to twist Jagex' arms in court and force the return of stolen e-property?

It's funny how I stated in my very article that in-game solutions will never work on a permanent basis, and then several people come up with in-game solutions :D In this instance as it was also with the Wildy Wall, all the programmer needs to adjust is a few parameters... But why should an in-game solution have to be permanent? In-game solutions can work on a temporary basis. This is exactly why a purely passive (automated) way of trapping bots will not work. It's bots against bots. But couple a human AI (i.e. JMod) to catch the offenders when the scenery/resource change happens and you make the bot detection smarter than the bots can ever hope to be. The linchpin is stern enforcement on Jagex' part when it comes to meting out punishment. I do not have faith in this company handing out stern punishments when it would have a negative impact on the bottom line.
  13. The goal is not (nor should it ever be) to eliminate 100% of the botting population. That is an impossible standard, and Jagex probably cant do a lot better than they are now. The goal should instead be to penalize & stigmatize botting until it becomes disused. This is where many believe Jagex is dropping the ball. Perception is everything, and Jagex needs to counter the impression that it has gone soft on botters. We need to see the naming and shaming as was done in the true Golden Age. If nothing else, it will give the clean players some inkling that Jagex is at least doing something. I like the idea of credit card bans. Sure, some people will still use other payment methods. But youve knocked some bad apples out and will put the fear of Guthix into the rest. The stat rollbacks are giving the impression that the monthly membership fee is the most important thing to Jagex. This perception that they have put recurring memberships ahead of the good of the game is a poison that will kill RS.

  17. I am going to get hated on for saying this, but I believe playing hours per 24 hour period should be metered. Six hours a day is enough, if not too much. 6 hours a day, every day is 25% of your freaking life.

  20. Sounds like a Winmodem (softmodem) to me. http://ubuntuforums.org/showthread.php?t=308098 I ran into the same problem when I tried Ubuntu. It didnt like my modem and I would have needed to buy a driver to use it under Ubuntu.

  22. If you arent hurting for bank space, you can also remove your email address and never get mail from Jagex. Thats what I did and I can safely ignore all emails claiming to be from Jagex.
