Almost every state in the US has laws against open containers in vehicles, whether driver or passenger. They don't need to sniff it. Beer bottles are nearly 100% guaranteed to be carrying one type of liquid. If you can smell it on someone, they've probably had more than a little. And by his own admittal, the OP is/was drunk.Yeah, I live in Canada but passengers still get tickets and it doesent matter how much you drink unless your driving and he smelt the alcohol on all us. Depending on where you live, having any sort of alcohol in the car with you when you're below the legal drinking age is at the very least ticketable. So now let us suppose that you fight this under the defense that the officer did not make sure it was beer in the bottle. You state your case, then the judge says, "Well, was their beer in the bottle?" Not much you can do there.Yeah they can dump out your alcohol and ticket you for being underage but I got lucky with that one I guess, along with my seatbelt. And good point, I guess there isnt really a way to fight it lol. Just pay it and be glad he didn't arrest you. warri0r45 Posted October 11, 2009 Share Posted October 11, 2009 alright well about an hour ago i was with some friends coming from a party and we got pulled over, i had a half full beer in my hand. i set it on the floor and the cop got me to stand outside. he looked in the car and found the beer on the floor and poured it out (without smelling it or anything, he just seen the bottle and poured it out). he asked whos it was and i admitted it was mine so my friend driving didnt get the ticket. he put me in the car and wrote me a ticket for $360 and asked me a buch of bull [cabbage] and asked if i could help him with drug dealers. is there anyway i can fight this ticket because i got better things to spend $360 on lol. im still half drunk so if i didnt spell good or this doesent belong here sorry! Are you underage? If so, then you only have yourself to blame and the only way you can get out of it is to lobby to change the law (good luck with that). And fighting the law would cost thousands of dollars, and seeing as its a just and resonable law, you won't be able to fight it anyways. So you have two options that I know of. Pay the ticket or don't. I suggest paying the ticket unless you want your own personal lear that will prevent you from ever having a loan for teh rest of your life until you pay it off, and it will probably have interest. Beer has a very very strong odor especially to a trained nose. He probably could tell someone in the car had been drinking before he even saw the can/bottle. The probability of you having some other type of drink in the beer can/bottle is highly unlikely and would be stupid so he really doesn't need to sniff the beer. Kids don't be stupid like this guy. The cop wasn't trying to get him for DUI anyway, just open container. I still don't get it, why is it illegal to have an open container of alcohol in a car? I could understand if he ticketed you for underage drinking, but I can't see the problem with passengers drinking in a car with a sober driver...
