April 12, 200719 yr Ok well, recently, I kinda got into a fistfight with some dude at my school. It was over a girl we know (my girlfriend) and I pretty much started it. Only about 6 punches were thrown, since he didn't even try to fight back. That was yesterday, and today he is talking to me saying his dad will file charges against me for assault. I don't really think he can do this, seeing as there was only a minor amount of physical pain I caused to this guy. This guy I'm talking about does talk a lot of bullplop to people, and he could just be lieing. But what I'm asking is if he did actually file charges, would he even have a good case? Because like I said, all I did was hurt him a little bit, nothing serious. Eight Bananas, MD.

April 12, 200719 yr worst that could happen is alot of community service and suspension (possibly expulsion) from school. Truthfully that would suck. I hope you don't get into trouble but I hope you learned that not matter what someone says it doesn't give you a right to hit them, regardless if it is the right thing to do.
April 12, 200719 yr Just say he threw the first punch and you were defending yourself. If it happened in school, you'll get suspended at most. Depending where you live, he might feel the need to sue you (if he says he's in constant pain or missed some work or whatever), people have been sued for less.

You didn't really say anything to defend yourself, which you're going to get suspended most likely. Unless you actually give us more information to prove you're 'good', you are the 'bad guy'. April 12, 200719 yr If you did that in the public schools around here you gight get a one or 2 day inschool detention (which is really worse than a normal one because you'ed proboly get bored), or normal one, if its the first time. Heck, here you might not get suspended at all. Now on assult, in the states I think you could end up with community service, in canada, you'ed probaly have to make an apology to the guy you hit and his faimily :roll: .

April 12, 200719 yr It could take months though for such a case to take any effect given that it doesn't hold much ground over cases that are far more important. And I almost think that it would be a waste to file any charges, a waste of money in hiring a lawyer and all that jazz. Besides that it's on school grounds, so any form of lawsuit seems far-fetched. It probaly is just him blowing smoke though, I'd doubt he would go through the trouble.

As Bubsa said, it's a pretty petty incident and you should probably be embarrased that you started the obvious meaningless violence (I know it's cliche, but it really dosen't achieve anything, it just gets you into hot water), but it would be pretty low of him to sue over something so miniscule, really (unless you broke is nose or something :uhh: ).

April 12, 200719 yr I disagree with most of the people here. Part of the reason for this is because I don't know the entire story and am therefore going to give you the benefit of the doubt. I don't promote or condone violence in general, but I think there are definitely reasons for fighting. How much bother you're going to get into will depend alot on the police in your area. An 'assault' such as this wouldn't be a big deal around here, and I very much doubt someone would file charges in the first place. La lune ne garde aucune rancune.
April 12, 200719 yr Where I live, if someone gets into/starts a fight they get a court hearing, and the standard sentance is $100+ fine and 50 hours community service, and sometimes a suspension. But if you don't try to lie to a judge, and are honest, i'm sure they'd let you go as long as the person you punched doesn't complain about any injury, especially if it handicapped him.

April 12, 200719 yr generally no, he cannot get you on any charges, exept for possibly some minor pain and suffering, but that would probably be a waste of time. If what you said is true and the fight was minor, then all that is likley to happen is a suspention of both of you from school. Assult charges are usually for cases when some one was beaten to a bloody pulp. All in all, from what you said, you can probably expect a suspention from school for a few days, but not much else. Usually things that happen on school property are handled by the school unless its somthing big.

April 12, 200719 yr Around here, there would be a case, but it would take a very long time to actually get to court. I highly doubt he will actually press charges, but if he does, you did assault him. The chances of it being taken beyond the school's principal are slim, though.
