Wallettheif Posted December 17, 2007 Share Posted December 17, 2007 Alright, so yesterday me and my friends were driving back from China town after we bought a couple fireworks (the legal ones) and we got pulled over. The cop demanded to search our car, saying he saw us leave with an 8-ball. He then searched us, told us to give everything we had to him (I had about $700 worth of stuff in my pockets, including a PSP, an Iphone, a DS, and some other crap.) he then demanded to search the glove box (which was locked) and, after I told him that he'd need a warrant to search locked compartments, he said, "Shut up, [bleep]face! You don't know [cabbage] about the law, you're just a high and [developmentally delayed]ed teen that cheated for his driver's license!" and, I got cuffed, and I was taken to the station and was questioned. (He didn't read my rights either- A big no-no. :shame: ) And then he asked for my wallet and he took out my license and school ID, put them in this thing that looked like a guillotine and cut them up then flushed them down the toilet. :cry: I asked him about the stuff that he took and he said that he'll give it back when he feels like it. Today, I was in court, and I told them everything that happened, and I had a video tape, too. (My friend recorded the incident while he was in the holding cell) and I showed them the tape, and the cop had to give me $600 and return my stuff to me. Turns out, he was abusing his power to steal stuff from us. The lawsuit is gonna be this Friday, and a lawyer is offering to represent us for free. So, do you have any experiences with the law? indy500fan Posted December 17, 2007 Share Posted December 17, 2007 I've had one. I was in a K-Mart parking lot with my friends, I thought it would be funny to push a shopping cart with my car. I barely nudged it, then decided it was a bad idea. Anyways, cops saw me and decided to pull me over when I left. They searched the car and searched my friend also. We were all clean but they made us come to the police station and called my parents and had them pick me up. I did something stupid, so I understand why they pulled me over. I have never had a serious run in with the police, but last year me and a about 20 friends or so had been to the cinema together and it was about 10pm at night and we were at the bus stop waiting for the bus to come. We were just standing around talking, none of us had been drinking, smoking or taking any drugs and these two police officers came over and told us to disperse. We then explained that we were just waiting for the bus so we could all go home. The police started to get angry and told us to move away or we would all be arrested. So we all walked away to another bus stop because we didn't want any trouble. It was annoying though because they only stopped us because we were in a large group and because we were kids. And to the police a large group of kids normally means trouble. It is stereotypical but there is nothing we can do about it. The way the world works. The way the world works.I suppose that seems a bit unfair on you, but someone walking past could be pretty intimidated by a big group of 20. I suppose it is a bit if a dilemma, mabie try going out in smaller groups in future and if you all want to go somewhere together, just arrange to meet up there and all get their and back different ways. It's a number provided by 911, but I forget what it's called. If they abuse you, then you have a right to take action as a citizen. Take them to court so they lose their job. I know the police are meant to serve and protect our community, but sometimes they go to far with things. Infact, I have been arrested once, but I did not go to jail because I was proven Innocent in the court of law (Which I was innocent in the first place.) You can, but technically police officers here in the U.S. don't have to show you If they refuse. Also, There are many undercover police officers, Off-Duty officers that out of suspescion of anything, can trying to enforce the law Badge or no badge. Nom Posted December 17, 2007 Share Posted December 17, 2007 I just finished a unit on this in my Government class, and I can tell you that the cop had no justification whatsoever for even stopping you, let alone searching you. You are correct that he can't search your locked glove compartment, but he can't even get that far - cops always need a warrant to search property, and they need at least reasonable suspicion that you are a threat to their own safety before they can even pat you down. They can still arrest you, but if they forget to read you your rights, then any information they get is not usable against you in court. As far as asking them if they were actually a cop, technically you can, but if some one stops you wearing a police uniform, driving a police car, its unlikely they are anybody other then a cop. There was one time, however, when I had an encounter with a transit officer on the train back when I was in high school. They're people who are employed by the rail company to catch fare evaders and people who are mucking around on trains. Anyhow, this guy was doing a routine check of people's tickets on the carriage, when he came up to check mine. I showed him my ticket and concession card to prove I was a student (I was out of uniform at the time, having been on my way home from fencing). He graciously informed me that my concession card expired on the 3rd of March - I think it was the 10th or something at that point - then tore it up without allowing me a response. I didn't like that. I pointed out to him, loudly so anyone who cared to be listening could hear, that he was hilariously wrong and the concession card actually expired on the 31st. There was an awkward silence. No harm done, because we were getting our renewed ones the next week anyhow. Too bad I didn't quite get his name, because then I would have given him hell through his employers for inconveniencing me for a week.
