Something has gone wrong here. The reason why CP is illegal is because it exploits children. Nobody is being exploited here, I would have thought that "visual representations of the sexual abuse of children" refers to images or videos of actual CP. Not manga.

While I don't agree with the ruling here, I believe that the people who are charging him have the same mentality as the people who want to ban violent videogames. They believe that if some kills (or has sex with minors, in this case) in a video game (or manga), they will do it in real life. I, personally, believe the opposite, that these people live their desires in these mediums, so they do not exhibit these illegal/taboo behaviors in real life.

Based on the details of the case, the punishment for this "crime" seems very harsh.

 

 

 

On one level I can understand the argument that might be used to justify the PROTECT act, that being that it might desensitise people to child porn or encourage them to do it. Having said that, the counterargument would be that a harmless cartoon could actually let pedophiles (not suggesting that the subject is one) get their fix without needing to abuse a child for real.

Well, I can prove it in a couple.

 

 

 

Firstly, in the Dragonball manga, Bulma is 16, it is said so, Goku is 14.

 

 

 

In Elfen Lied, well, Nana is said to be 15, if I remember, and the other one (Number 35 or 37, I forget) is definately underage. We know that because we are given a rough idea of her age.

 

 

 

That being said, I don't own these, however, if I did, I sure as hell would not get rid of them. Trying to justify they are CP is moronic, since the nudity is minimal, and you'd just be looking for a reason to arrest me.

I suppose the banning of any form of CP is good for the world. /b/ and the art boards of 4chan would be shut down. But then there are problems with arresting for possession of manga comics. Most CP viewers probably have an insatiable addiction to the stuff. They know where to find it and everything. If their comics were banned, how do we know they won't decide to look for the real stuff instead of satisfying themselves with drawings? Honestly, 15 years for a hobby? it might be a rather obscene hobby, but it's better than him actually exploiting children to quench his thirst for pornography.

 

 

 

And besides, unless the book actually states the character's age, how do we know the character isn't an adult? Banning manga calling it "child porn" won't do anything because the writer would simply avoid giving the character's actual age and instead just make it look like the character is young. And appearances aren't good enough evidence in a court of law.

Whilst I respect the intentions of the PROTECT act (protecting children) I think the law is misguided and possibly ineffective. 15 years is a massive jail sentence when rapists often get away with less, and this really does come into the grey area of at what point fantasies become criminal. We don't prosecute people for the fantasies they have but simply drawing them wouldn't make much difference. But then again they have to be seen to discourage it.

 

 

 

It's tricky either way, but the sentence is ridiculous. The sentence should be appealed.

I swear, it seems like we are the only country that has such an insane legal system. People are put away because they have considered robbing a bank (they call this intent) here. "The land of the free" yeah, more and more it seems like this has become a convenient veil behind which these people- those special interest groups that lobby for these laws- can hide behind. I mean, we are told, every day, that this is a free country, constant propaganda about freedom and liberty, but more and more I see us becoming a police state where if you say, or even think something that the majority finds offensive, your in for some pretty hard times.
